Unofficial Warmoth Soundtrack - Sweet, Sweet Victory

Wow look how complicated we can make this!  :doh:

I had a feeling...Anyway, why don't we just say originals only?
It'll be a better window into our forum that way, it think.
C'mon everybody, c c c'mon everybody! Lets see what we're creating!
 
I think we as a group are over thinking it, over complicating it, and setting a level of expectation that will be hard to reach.

The thing to remember is that most (not all) of the submitted tracks will be home or live recordings where the quality of the recording will be sub-par. So I doubt this will be a commercially viable compilation of recordings. In reality it will be recordings for a group to enjoy.

I always encourage originals, just because...well just because!
...Anyway, the important thing is that its tunes from contributors and its really fun!

Whatever the quality, this aint gonna be a commercial release, so I'm not even worried about coyright whatever anymore.

That was my point - if a copyright holder doesn't smell money to be made by a lawsuit, the chances of getting sued are really really tiny. A lawyer either gets paid by the hour or expects a big cut of a final settlement - if there isn't a reasonable expectation that a lawsuit will bring big $, then a lawsuit just doesn't happen. I see zero issue with disseminating, for free, a bunch of amateur recordings. Except that I can understand why Warmoth wouldn't want its employees putting covers out there, because a decent sized company is inherently more vulnerable to a lawsuit.
 
Over the last eight years or so I've been active on a couple of homerecording bbs' and combined there have been at least four releases with songs from bbs members.
Covers weren't allowed specifically to avoid these issues. Even (draft) songs posted for others to comment on the recording and mixing skills were strictly originals.

So really, don't bother about covers. Others before us didn't either, and for a reason. It's been a big reason why I never participated in these cd's because I'm not much of a songwriter but that's just the way it is.

If I'm the odd man out, I'll just switch it with an original song.  Not as good a song mind you...
 
Wow this got more complicated then the raffle!!!!! I didn't contribute so I have no right to add my 2 cents so I will just sit back and watch. I would however love to hear the final product.

No, don't pull that cover... It is a great tune!
I think along the line of the past few posts.  Too much is being made of this.
The Warmoth CD likely will not go much further than our group of devotes.
I am really anxious to hear this gem...  Good luck to all that contribute  :headbang1:
 
There's a fabulous write up about how to release covers on the CDBaby website..

It's under "Digital Distribution FAQ", then.. "How to sell an album that has cover songs".  It applies to both on-line and actual CD sales.

Basically you need to get a compulsory license from the Music Publisher of each individual songs, then once or if you work out all the legal junk with them you still need to get a a CPA to report your total sales (free or otherwise) on a monthly basis to them and pay a per song, per minute, royalty fee for each album sold, downloaded, given away, etc, etc...

and of course that's only the US.

I know the Unofficial Warmoth board is pretty small beans and you could probably get away with it, but considering it is public and easily Google Searchable, just to avoid any legal hassles, I'd probably stick with originals. ;-)

This is my viewpoint on the thing. Did Mayfly do the only cover so far?

But since Mayfly owns the copyright (I assume?), there's nothing to worry about unless he enforces it. And since Mayfly basically donated it to the project, he's basically giving up that copyright protection. :icon_thumright:

I'm now second guessing what he meant, but I'm sure he didn't play every instrument on the recording, so it's more than just him with a stake in it.  Also, the nature of copyrighting, more than the artist gets paid.  Just to play Devil's Advocate, depending on the arrangement between those involved, other people on the recording receive payment regardless of them writing the piece.  If I wrote a song and recorded it with other people and give them a cut, and I give it away......

The Doors can't even call themselves The Doors and perform songs they wrote w/out Jim Morrison's estate getting paid, even on song's he didn't write.
