My Frankenstrat has a Warmoth Pro neck on it. I didn't even think about it until just now when I saw the side adjuster again. I didn't put this guitar together, I commissioned the builder who did the paint work and aging/relic'ing of the guitar. He assembled it and I bought it as a completed guitar about 6 yrs ago, so I didn't even think about it when the soundtrack idea came up.  :doh:

I've got you added.

I'm also trying to get a hold of Wyliee or Gregg to see if they might add a track to the project.

Also, there are two people working on this. Rouse is compiling it all, I'm just keeping the thread together. So I couldn't tell you one way or another if he got your track.

He says he's not for sure, but there might be issues with putting cover tunes on our album. This could be an issue for Mayfly at least, possibly more.

Does anyone know for sure how this works? We are not selling this album, but I also don't want to end up with lawyers after the forum or anything.
 
I don't have a really detailed understanding of it, just that publishing cover tunes is very different than performing cover tunes...
Just for safety's sake, I'd suggest that we do originals only. There is always the possiblity of a problem when it comes to the publishing rights.
I know, I know, we're not making any actual CD's nor are we charging for it, but I just keep thinking of the warning at the beginning of movies "Including infringement without monetary gain..."
 
If you want to be safe, you simply purchase the mechanical license for the cover tunes that you'll be putting on the CD.  This is administered by the CMRRA.

Then you are covered for sale of the album.

The mechanicals are pretty cheap - like $50 per song or so.

Problem solved - as long as we can recover the cost through sales.

(p.s. for my originals you'll actually have the same problem....)
 
In order for lawyers to get involved, someone with the rights to the originals has to: 1) get pissed that we are doing this and / or 2) think they could get significant money out of those responsible. Neither seems remotely likely, to me.
I doubt even Metallica would sue a bunch of gearheads distributing covers to each other. The Warmoth folks, well this is their job so they need to do what they're told in this regard. Understandable if you're a company that looks even remotely "sueable".

So we'd need to come up with $500+ via sales..?  :sad1:

Actually, out of all big bands I figure Metallica would be one of the first to jump in.



So how do we want to handle this? When this was done on Warwick's forums, it was all originals and the issue never even came up.
 
I don't think there is much to worry about, as long as it's a free listen/download. If Unofficial Warmoth was making money off of it there could be problems.

well, in most cases if you like the cover and want to include it, you make the decision to pay for the mechanicals.  If you don't, then you insist on original recordings.

such decisions need to be handled by our budding record company exec  :icon_jokercolor:

P.S. the $50 licenses you for 500 copies of the licensed song.

Well, I was thinking of doing an blues instrumental over an A blues backing track. In this jam it's basically a blues jam with some famous licks from Eruption showing up here and there. I call it my "Van Halen Blues" and like to play it live whenever I'm on stage. People really get a kick out of it, hehe!!
