A Washington man is suing Hansen Beverage Company, the maker of Monster Energy Drinks, after claiming he found a dead mouse at the bottom of a can—and has pictures and lab testing to support his case, KREM.com reported.

Vitaliy Sulzhik, 19, of Federal Way, Wash., said he finished drinking a Monster Energy Drink, which he bought at a local Fred Meyer supermarket and realized the can wasn’t empty.

"I put it down, and I felt it was still heavy. So I backwashed it, and all this debris went into my mouth," said Sulzhik of the March 2010 incident. "Then I looked in the can, and I saw the tip of the tail, and I vomited everywhere."

But it wasn’t just a tail—it was an entire dead mouse.

Sulzhik got an attorney, who sent the can to MDE Inc., a Seattle-based lab, which conducted a number of tests. The tests revealed that there was no trauma or poison involved in the mouse’s death.

"You hear these wild stories out there. Sure, you're a little skeptical at first," said Reed Yurchak, Sulzhik's attorney. "But everything here has checked out."

Hansen Beverage Company is aware of all the information, but Yurchak said they refuse to believe his client. They have declined to comment on the lawsuit.

I don't think I will drink anything out of a can for a while.

Meh, I think I'm with Monster on this one. It's highly unlikely that this could have happened. That's a good thing!

OTOH, I've already gotten in the habit of washing my soda cans before opening them, for no reason whatsoever. I'm fighting the urge to want to start checking them with a flashlight now. :blob7:

I would try lizard Sake though.

well I look at it like, hey anyone checking the cans before they are filled or is it an automatic line? maybe if we had a person there..........

Anyone wonder if this was possibly the guy's inspiration?

I've always though of mice as being pretty energetic. What's this guy's beef?* What a crank.

*(or rodentmeat, as the case may be)

Wow. Monster slapped that guy's balls. Way to go. I hope they counter-sue for defamation. Nothing much, just have the guy cover THEIR legal bill.

I have to say that I feel sorry for the mouse and want to sue Monster for

wrongful death of the mouse.

I can think of a reason. Stockboys use 6, 12 and 24 packs of cans as step stools to get at things on higher shelves. So, unless you wanna eat whatever's on the bottoms of their shoes, you need to wash the can tops.

Having spent 2 years stocking soda I can safely say we don't do that too long. the first time you shift your weight and 3 cans pop open, spraying all around you and destroying product... is also the LAST time you wanna explain that to your manager!

I'm just thinking of back 100 years ago when I did a brief stint as a stockboy. Cans were a little more robust back in those days; aluminum and pop-tops were almost unheard of in that application. It was all coated steel you had to use openers on. But, you are admitting that you've done it, as have your co-workers, even if only briefly until you learn a lesson. So, the advice still applies.

The Mythbusters did a myth once, that if I recall, was about rats walking along the tops of the cans, getting traces of urine everywhere.
They swabbed a bunch of cans from every place they could find and tested for whatever they were looking for, but concluded that all of the cans were clean.

Actually, just a few years ago, I had some family visit from abroad, and the kids were freaking out that we weren't washing our soda cans, because they were afraid of rat piss.
I didn't care in the slightest, and still don't, but since then, I've taken up the habit of rinsing the tops off in the sink before I open a can.
