Hi guys just got a nice warmoth neck that was tru oiled by the previous owner. I want to make the face and back of the headstock black. can I spray nitro over the tru oil or do I need to sand it all off first.

Lacquer will eat thru truoil quicker than you can say "whoopsiepie banana daddy".

Gotta take it down.  Personally, I'd strip the whole neck, do it stripper, and then lacquer the whole thing

I really like the tru oil on the back of the neck. just want to change the headstock face and back..

You could seal off the Tru-oil with a couple coats of shellac, but assuming there are more than a couple layers of Tru-oil then it's all gonna get pretty thick.

I'm with CB, strip it, tint it to match the color you like then shoot your lacquer.
